Privacy policy

This policy applies to personal information we collect through katalystos.com, including its Spanish-language pages (together, the “Site”), and through your communications with us, such as when you request a demo or contact our team.

The Site is a business-to-business website that provides information about Katalyst’s restaurant point-of-sale (POS) platform and related services. This policy does not apply to:

• Katalyst products and services provided to customers, such as the Katalyst POS platform, the merchant login portal, and online ordering, which may be subject to separate agreements or privacy notices
• Information that restaurants and other businesses using Katalyst products collect about their own customers, which is handled under those businesses’ own privacy policies
• Third-party websites and services that the Site links to, such as social media sites and online scheduling tools, which have their own privacy policies

Information you provide to us

When you request a demo or contact us through the form on the Site, we collect the information you enter:

• Your name and email address
• The name and location of your restaurant or business
• The products or features you are interested in
• Any other details you choose to include in your message

We also record the language of the page from which you submitted the form, so that we can reply in that language.

If you contact us by email or phone, we collect the information you choose to share with us, such as your contact details and the content of your communication.

Please do not include sensitive information, such as payment card numbers, Social Security numbers, or health information, in form submissions or messages. The Site does not ask for payment card information.

Information collected automatically

When you visit the Site, we and our service providers automatically collect certain technical information, such as your IP address, browser and device type, operating system, referring website, the pages you view, and the dates and times of your visits. A general location, such as your city or region, may be inferred from your IP address. This information is collected through server logs and through the cookies and similar technologies described in Section 4.

We use the information described in this policy to:

• Respond to your demo request or inquiry and communicate with you about Katalyst products and services
• Send you information about Katalyst products, services, and events, which you can opt out of at any time as described in Section 8
• Operate, maintain, and secure the Site
• Understand how visitors use the Site and improve its content and performance
• Detect, prevent, and respond to fraud, abuse, security incidents, and other harmful or illegal activity
• Comply with legal obligations, respond to lawful requests, and enforce our terms and conditions
• Carry out other purposes that we describe to you when we collect the information, or with your consent

The Site uses cookies and similar technologies. Cookies are small text files that your browser stores on your device.

Analytics

We use Google Tag Manager to manage scripts on the Site and Google Analytics to measure and understand how the Site is used, for example which pages are visited and how visitors arrive at the Site. Google Analytics uses cookies and collects information such as your IP address, device and browser information, and the pages you view, and provides us with reports about Site usage. Google processes this information under its own terms and privacy policy. You can learn more at How Google uses information from sites or apps that use its services, and you can prevent Google Analytics from collecting information about your visits by installing the Google Analytics opt-out browser add-on.

We use analytics to understand and improve the Site, not to show you targeted advertising.

Preferences

If you choose a language using the Site’s language selector, we store that choice in a cookie so that the Site continues to show your preferred language. The Site may also use your browser’s language setting to show you pages in a matching language.

Managing cookies

Most browsers let you block or delete cookies through their settings. If you block cookies, some features of the Site, such as remembering your language choice, may not work as intended.

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under California law.

We may disclose personal information to the following categories of recipients:

• Service providers that process information on our behalf to help us operate the Site and our business, such as website hosting, analytics (Google), and email and communications providers
• Professional advisors, such as lawyers, accountants, and auditors, where needed for the services they provide to us
• Legal authorities and others, when we believe in good faith that disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of Katalyst, our customers, users, or others, including to detect and prevent fraud or security incidents
• Parties to a business transaction, such as a buyer or successor, in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case personal information may be among the transferred assets
• Other parties with your consent or at your direction

We may also share aggregated or de-identified information that cannot reasonably be used to identify you.

We keep personal information for as long as reasonably necessary for the purposes described in this policy, such as responding to your inquiry and maintaining our business relationship with you, unless a longer retention period is required or permitted by law. When we no longer need personal information for these purposes, we delete it or de-identify it, or, if that is not reasonably practicable, we securely store it and isolate it from further use until deletion is possible.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no website, data transmission over the internet, or storage system can be guaranteed to be 100% secure, and we cannot guarantee the security of information you send to us.

• Marketing emails: You can opt out of marketing emails from Katalyst at any time by using the unsubscribe link in the email or by contacting us as described in Section 13. Even if you opt out, we may still send you messages related to a request you have made.
• Cookies and analytics: You can manage cookies through your browser settings and prevent Google Analytics from collecting information about your visits as described in Section 4.
• Updating your information: You can ask us to update or correct information you have provided by contacting us as described in Section 13.
• Privacy signals: See Section 10 for how we respond to Global Privacy Control and Do Not Track signals.

Depending on where you live, and subject to exceptions in applicable law, you may have the rights described in this section.

California residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), may give you the following rights regarding your personal information:

• Right to know and access: to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collecting it, and the categories of third parties to whom we disclose it
• Right to delete: to request that we delete personal information we have collected from you
• Right to correct: to request that we correct inaccurate personal information we maintain about you
• Right to opt out of sale or sharing: to opt out of the sale of your personal information or its sharing for cross-context behavioral advertising. As described in Section 5, we do not sell or share personal information
• Right to limit use of sensitive personal information: to limit certain uses and disclosures of sensitive personal information. We do not ask for sensitive personal information through the Site, and we do not use or disclose sensitive personal information for purposes that would require us to offer this right
• Right to non-discrimination: we will not discriminate against you for exercising any of these rights

In the preceding 12 months, we have collected the following categories of personal information: identifiers (such as your name, email address, IP address, and cookie identifiers); professional information (such as the restaurant or business you are associated with); internet or other electronic network activity information (such as your interactions with the Site); general location information (such as the location you enter in our form, or a city or region inferred from your IP address); and any other information you choose to include in a message to us. We collect this information from you, from your browser or device, and from our analytics provider, for the purposes described in Section 3. We disclose it for business purposes to the categories of recipients described in Section 5, and we keep it as described in Section 6.

We do not disclose personal information to third parties for their own direct marketing purposes.

Residents of other states

Residents of other states with comprehensive consumer privacy laws, such as Colorado, Connecticut, Oregon, Texas, and Virginia, may have similar rights, including the right to confirm whether we process their personal data, to access, correct, and delete it, to obtain a copy of it in a portable format, and to opt out of targeted advertising, the sale of personal data, and certain profiling. If we decline to take action on your request, you may appeal our decision by replying to our response or by emailing [email protected] with the subject line “Privacy request appeal.” If your appeal is denied, you may contact your state attorney general.

How to submit a request

To exercise your rights, email us at [email protected] with the subject line “Privacy request,” or call us at (888) 996-8486. To protect your information, we will take reasonable steps to verify your identity before responding, such as asking you to confirm information we already have about you, like the email address you used to contact us. We will respond within the time required by applicable law.

Authorized agents

You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof that you gave them signed permission to submit the request, and we may ask you to verify your identity directly with us or to confirm that you gave the agent permission, unless the agent provides a valid power of attorney or applicable law provides otherwise.

Some browsers and extensions can send a Global Privacy Control (GPC) signal. Where required by applicable law, we treat a GPC signal as a valid request to opt out of the sale or sharing of personal information associated with that browser or device. As described in Section 5, we do not sell or share personal information.

Some browsers also offer a “Do Not Track” setting. Because there is no common industry standard for how to interpret Do Not Track signals, the Site does not currently respond to them.

The Site is intended for businesses and is not directed to children under 13. Persons under 13 are not permitted to use the Site, and we do not knowingly collect personal information from children under 13. We also do not sell or share the personal information of consumers under 16. If we learn that we have collected personal information from a child under 13, we will delete it promptly. We may update this privacy policy from time to time to reflect changes in our practices or in applicable law. When we do, we will post the updated policy on this page and update the “Last updated” date above. If we make material changes, we will provide additional notice where required by applicable law, such as a notice on the Site. We encourage you to review this page periodically.
